Terms of Service

Welcome to StudyFirst! These Terms of Service ("Terms") govern your use of the StudyFirst app for iPhone and iPad, the StudyFirst web app and the website studyfirst.app (together, the "Service"), operated by Sevelopment OÜ, a company registered in Estonia (registry code 14002422) ("StudyFirst," "we," "our," or "us").

By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access the Service.

1. Description of Service

StudyFirst is a parental control and educational app that:

Generates AI-powered study questions for children
Integrates with Apple Screen Time to manage app access
Requires children to complete study sessions before accessing entertainment apps
Lets parents follow their child's progress and every answer, in the app and on the web

2. Eligibility

You must be at least 18 years old to create a parent account
The Service is designed for children in grades 1-7 (approximately ages 6-13)
Parents/guardians are responsible for their children's use of the Service

3. Account Registration

You must provide accurate and complete information when creating an account
You are responsible for maintaining the security of your account
You must notify us immediately of any unauthorized use of your account
A family can have several parents, each with their own account, and several child profiles

4. Subscriptions and Payments

StudyFirst requires a subscription: the Single Child plan covers one child (the first one you added), the Family Plan any number of children. A family's plan covers all of its parents
New subscribers get a 1-week free trial. Unless you cancel at least 24 hours before the trial ends, the subscription starts and the plan's price is charged
Subscriptions are billed through your Apple Account, at the price the App Store shows in your currency, and renew automatically unless cancelled at least 24 hours before the end of the current period
You can change or cancel your plan in your Apple Account's subscription settings, also reachable from the app's Profile
When a subscription ends, StudyFirst pauses: your child's apps are no longer blocked and new study questions stop until you subscribe again
Deleting your StudyFirst account doesn't cancel your subscription; cancel it in your Apple Account settings
Refunds are handled by Apple according to the App Store's policies

5. AI-Generated Content

Study questions are generated using artificial intelligence (OpenAI)
While we strive for accuracy, AI-generated content may occasionally contain errors
The Service is a supplement to, not a replacement for, formal education
We do not guarantee specific educational outcomes or grade improvements

6. Screen Time Integration

StudyFirst uses Apple's official Screen Time APIs (FamilyControls, ManagedSettings) to block apps
Your child's iPhone or iPad must be signed in with your child's own Apple Account in your Family Sharing group, and a parent must approve StudyFirst's Screen Time access on it
App blocking is enforced at the iOS system level
We are not responsible for limitations or changes in Apple's Screen Time functionality
The effectiveness of app blocking depends on proper device configuration and iOS version

7. Acceptable Use

You agree NOT to:

Use the Service for any illegal purpose
Attempt to bypass or circumvent any security features
Share your account credentials with others
Use the Service to harm, harass, or exploit children
Reverse engineer or attempt to extract the source code
Use automated systems to access the Service

8. Intellectual Property

The Service and its original content are owned by Sevelopment OÜ
Our trademarks and trade dress may not be used without permission
AI-generated questions are provided for personal educational use only

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

10. Limitation of Liability

TO THE EXTENT THE LAW ALLOWS, IN NO EVENT SHALL SEVELOPMENT OÜ BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

Nothing in these Terms limits liability that the law doesn't allow to be limited, or your rights as a consumer.

11. Indemnification

You agree to indemnify and hold harmless Sevelopment OÜ and its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

12. Termination

We may terminate or suspend your account at any time for violations of these Terms
You may cancel your account at any time through the app or by contacting us
Upon termination, your right to use the Service will immediately cease

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of significant changes through the app or by email. Continued use of the Service after changes constitutes acceptance of the new Terms.

14. Governing Law

These Terms are governed by the laws of Estonia, without regard to its conflict of law provisions. If you use StudyFirst as a consumer, you also keep the protection of the mandatory consumer laws of the country where you live.
